1. Service description
NumClean is a phone-number validation and list-hygiene service operated by BLUT LTD, a company registered in the United Kingdom. The service performs live HLR (Home Location Register) lookups to determine the reachability, line type, porting status, and carrier of mobile phone numbers submitted by the customer.
NumClean operates on a pay-as-you-go basis. There are no subscriptions, commitments, or minimum volumes. Pricing is tiered by volume as published on our website.
2. Customer consent and rights warranty
By using the NumClean service, the customer represents and warrants that:
- They have the lawful right to process every phone number they submit for validation.
- They have obtained all necessary consents required under applicable law — including, without limitation, the Protection of Personal Information Act (POPIA), the General Data Protection Regulation (GDPR), and any local opt-in or telecommunications regulations — to submit these numbers for validation purposes.
- The phone numbers were collected lawfully and in compliance with all applicable data protection and privacy laws.
- They will use the validation results only for lawful purposes consistent with the consents obtained from the data subjects.
This responsibility lies entirely with the customer. BLUT LTD does not verify whether customers have obtained the appropriate consents and accepts no liability for a customer's failure to do so.
3. Acceptable use — no abuse
The customer agrees not to use NumClean or its validation results for any of the following purposes:
- Spam — unsolicited bulk messaging to individuals who have not opted in to receive communications.
- Grey-route messaging — routing messages through unofficial or unauthorised channels to circumvent operator agreements or regulations.
- Illegal or unauthorised messaging — any messaging that violates applicable telecommunications, consumer protection, or data protection laws.
- Fraud or harassment — using validation data to facilitate deceptive, abusive, or harmful communications.
We reserve the right to immediately suspend or terminate the customer's access to the service if we reasonably believe a violation of this clause has occurred, without prior notice and without refund of any prepaid amounts.
4. No accuracy guarantee — "as is"
Validation results are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. Specifically:
- Reachability is a best-effort live signal, not a delivery guarantee. Network conditions, temporary outages, roaming, and other factors may affect the accuracy of results at any given moment.
- Validation reflects the state of the network at the time of the query. A number's status may change immediately after validation.
- We do not warrant that results will be error-free, complete, or suitable for any particular purpose.
We strongly recommend that customers run a test batch before committing to a full send, particularly for large or high-value campaigns. NumClean is a pre-send hygiene tool, not a substitute for proper delivery infrastructure and monitoring.
5. Limitation of liability
To the maximum extent permitted by applicable law:
- BLUT LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of revenue, loss of profits, loss of data, or business interruption — arising out of or related to the use of or inability to use the service, even if we have been advised of the possibility of such damages.
- Our total aggregate liability for any claims arising under or in connection with these terms shall not exceed the total fees paid by the customer to BLUT LTD during the three (3) months immediately preceding the event giving rise to the claim.
- Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
6. Billing
NumClean operates on a pay-as-you-go model with volume-based tiered pricing as published on our website:
- 1 – 10,000 numbers: $0.010 per number
- 10,000 – 100,000 numbers: $0.007 per number
- 100,000 – 500,000 numbers: $0.005 per number
- 500,000+ numbers: $0.004 per number
Charges are based on the number of lookups submitted. Please note that numbers which return an inconclusive or failed result may still be counted as processed lookups, as the underlying network query is performed regardless of the outcome. We aim to minimise such occurrences and will work with customers on a case-by-case basis where failure rates are unusually high.
Prices are quoted in US Dollars and are exclusive of any applicable taxes. We reserve the right to update pricing with reasonable advance notice.
7. Indemnity
The customer agrees to indemnify, defend, and hold harmless BLUT LTD, its directors, officers, employees, and agents from and against any third-party claims, demands, damages, costs, and expenses (including reasonable legal fees) arising out of or related to:
- The customer's violation of these terms.
- The customer's failure to obtain proper consent or lawful basis for the phone numbers submitted.
- The customer's misuse of validation results, including but not limited to use for spam, illegal messaging, or any purpose that violates applicable law.
- Any claim by a data subject or third party related to the customer's phone number list or the customer's communications.
8. Data handling and privacy
Our processing of personal data in connection with the service is governed by our Privacy Policy. Key points relevant to these terms:
- Uploaded number lists are processed and then deleted within 48 hours of results delivery.
- We act as a data processor on the customer's instructions; the customer remains the data controller of their list.
- Numbers are transmitted to a third-party telecom data provider solely for the purpose of performing validation lookups.
9. Termination
Either party may terminate this agreement at any time:
- The customer may stop using the service at any time. No notice is required.
- BLUT LTD may suspend or terminate a customer's access immediately and without notice if the customer breaches these terms, particularly the consent warranty (Section 2), acceptable use (Section 3), or indemnity (Section 7) provisions.
- Upon termination, any outstanding balances remain due, and we will delete any customer data in our systems in accordance with our retention policy.
10. Governing law and jurisdiction
These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to these terms
We may update these terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Material changes will be communicated to active customers via email where possible. Continued use of the service after changes are posted constitutes acceptance of the revised terms.
